AUTONOMIA DECISÓRIA DOS PACIENTES EM FASE TERMINAL: O DIREITO À MORTE DIGNA

Resumo

O presente artigo tem por finalidade considerar o princípio da dignidade da pessoa humana frente à autonomia decisória em pacientes em fase terminal, no desígnio de morrerem de forma digna, optando pelo destino de seu tratamento médico de forma à melhor realização de seus desejos existenciais. Para atingir o objetivo, foi realizada uma pesquisa de cunho bibliográfico, exploratório, utilizando-se o método dedutivo. Assim, será averiguada a possibilidade de o paciente em fase terminal optar pelo fim da própria vida, de forma digna e em respeito à sua autonomia decisória, encontrando-se, aí, o problema de pesquisa. Justifica-se a escolha do tema, por seu relevante valor moral e social, além de sua notória discussão na órbita jurídica. Pode-se concluir, por fim, que, embora controversa a temática de possibilidade de escolha pela morte digna, longe do enfrentamento de uma possível obstinação terapêutica, faz-se necessário ponderar-se o tema sob a perspectiva dos direitos dos pacientes, titulares de suas vidas.

Abstract: The present paper aims to ponder over the principle of the dignity of the human person before the decisional autonomy in patients in terminal stage who aim to die in decent way, choosing their medical treatment in order to better accomplish their existential wishes. In order to reach the goal, it has been made a bibliographic and exploratory research by using the defective method. Thus, it will be analyzed the possibility of the patient in terminal stage to opt for the end of their lives in a dignified manner in respect to the decisional autonomy which is the basis of the research. The choice of this issue is justified by its moral and social relevance, not to mention its notorious legal discussion. Therefore, it can be concluded that, although the issue about decisional autonomy is controversial, it is necessary to consider the theme from the patients’ perspective and rights.
