O DEPOIMENTO PESSOAL MEDIANTE PREPOSTO E A POSSIBILIDADE DE APLICAÇÃO DA PENA DE CONFISSÃO – IMPLICAÇÕES NOS PRINCÍPIOS DA VERDADE REAL E DA COOPERAÇÃO

Resumo

A recusa em prestar esclarecimentos em juízo sobre os fatos narrados na causa leva à pena de confissão ficta quando a parte, intimada a tanto e previamente advertida, nega-se ou falta ao depoimento pessoal. Essa pena vem sendo mitigada em diversos casos em que a ré é pessoa jurídica e o depoimento pessoal é prestado por preposto que desconhece os fatos narrados na inicial. Esse estudo confronta a pena de confissão com os princípios da verdade real e da cooperação expressos no Novo Código de Processo Civil. A metodologia científica empregada será pelo método dialético, com abordagem qualitativa, mediante pesquisa bibliográfica doutrinária e jurisprudencial. O objetivo é a comprovação da violação de tais princípios quando permitido ao preposto da ré pessoa-jurídica negar aos esclarecimentos sob a alegação de desconhecimento dos fatos.

Abstract: The refusal to provide clarification in court on the facts narrated in the case leads to the penalty of fictional confession when summoned and warned, deny or lack personal testimony. This sentence has been mitigated in several cases where the defendant is a legal person and personal testimony is provided by a person who is unaware of the facts narrated in the initial case. This study confronts the penalty of confession with the principles of real truth and cooperation expressed in the New Code of Civil Procedure. The scientific methodology used will be by the dialectical method, with a qualitative approach, through bibliographical research doctrinal and jurisprudential justice. The purpose is to prove the violation of principles when it is allowed to the agent of the legal person refuse to clarify under the allegation of ignorance of the facts
